The right to receive unemployment assistance
You give everything in a company and, suddenly, without expecting it, you find yourself unemployed. The unemployment situation is very hard, especially for those who have given the best years of their lives in a job and also carry family charges, a mortgage and endless household expenses that imply a minimum monthly contribution of money .
The truth is that, in this situation, knowing that we have unemployment benefit helps, and a lot, to weather the storm, because it gives us some economic security until we find a new job and the relief of thinking that, for the moment, you will have covered your basic expenses and those of your family.
Unemployment benefit, origins
It was during the republican government of Niceto Alcalá Zamora when José Largo Caballero, then Minister of Labor, launched the National Fund against forced or involuntary work stoppage, a coverage that was paid halfway between the State and the benefits of employers and workers, and that it represented more or less a third of the salary and between three and six months of duration. The system was maintained between 1932 and 1933.
However, the first national unemployment insurance law was approved in 1961, during the dictatorship, and supposed a coverage of 75% of the salary for six months for those who were registered in the system of what at that time was supposed to be the embryo of the Social Security in the regime employed by others.
Who is entitled to receive unemployment assistance?
Currently, any worker who has contributed under this chapter for at least 360 days in the six years prior to becoming unemployed, is registered in the State Public Employment Service, has lost his job for reasons is entitled to unemployment benefit. beyond your control, is affiliated or registered with Social Security in a scheme that contributes for unemployment and has not reached the age that allows you the right to collect the retirement pension.
In addition to the benefit, there is a subsidy that the Government grants to those workers who do not have the right to receive the contributory benefit, it is an economic aid to alleviate their situation. Like the previous one, it is limited to meeting certain requirements.
Characteristics of unemployment benefit
The contribution time in the last six years will determine the duration of the benefit. There is a minimum, 12 months of contributions, in this case four months are charged and from then on, two months for every six months worked, up to a maximum of two years.
As for the amount, it will depend on the regulatory base set by Social Security and that is the average of the contribution bases in the last six months worked. The first 180 days of benefit are charged 70% of the regulatory base and from there, 50%.
Of course, there is a maximum limit above which you cannot charge, even if the regulatory base is higher, and also a minimum. The maximum is as follows:
- Maximum contributory benefit without children (175% IPREM): 1,098.09 euros.
- Maximum contributory benefit with one child (200% IPREM): 1,254.86 euros.
- Maximum contributory benefit with two or more children: 1,411.83 euros.
Regarding the minimum (in case of having worked full time):
- Minimum contributory benefit without children is (80% of the IPREM + 1/6): 501.98 euros.
- Minimum contributory benefit with one or more children (107% IPREM + 1/6): 671.40 euros.
